AN INTERIM ORDINANCE ESTABLISHING A TEMPORARY MORATORIUM FOR EXTERIOR BIO FUEL BURNERS WITHIN THE CITY OF LESTER PRAIRIE
WHEREAS, Minnesota Statute 462.355, Subd. 4, authorizes a municipality that is considering adopting or amending official land use controls to adopt an interim ordinance restricting certain land uses for an initial period not to exceed 12 months; and
WHEREAS, with the increased cost of fuel, Lester Prairie residents and businesses have sought alternate ways of obtaining fuel; and
WHEREAS, the City of Lester Prairie does not currently regulate the bio fuel burners; and
WHEREAS, the City of Lester Prairie is considering regulating bio fuel burners;
WHEREAS, the City of Lester Prairie is desirous of adopting an interim ordinance as provided by Minnesota Statute 462.355, Subd. 4, for the purpose of protecting the planning process and the health, safety and welfare of its citizens during the preparation and consideration of land use controls involving bio fuel burners.
NOW THEREFORE THE CITY OF LESTER PRAIRIE DOES HEREBY ORDAIN THAT:
1. The City of Lester Prairie adopts an interim ordinance in accordance with Minnesota Statute 462.357 establishing a one-year moratorium on the construction, installation and use of private bio fuel burners under the following terms: a) the moratorium will apply to all zoning districts in the City of Lester Prairie b) the moratorium does not apply to bio fuel burners in effect at the time of the adoption of this ordinance nor to the maintenance of those systems c) this interim ordinance may be terminated by motion of the City Council prior to its stated expiration date.
