SUMMARY OF ORDINANCE NO. 281
AN ORDINANCE GRANTING
CENTERPOINT ENERGY RESOURCES CORP., d/b/a CENTERPOINT ENERGY MINNESOTA GAS (“CENTERPOINT ENERGY”), ITS SUCCESSORS AND ASSIGNS, A NONEXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN FACILITIES AND EQUIPMENT FOR THE TRANSPORTATION,
DISTRIBUTION, MANUFACTURE AND SALE OF GAS ENERGY FOR PUBLIC AND PRIVATE USE AND TO USE THE PUBLIC WAYS AND GROUNDS OF THE CITY OF LESTER PRAIRIE, MCLEOD COUNTY,
MINNESOTA, FOR SUCH PURPOSE; AND, PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOF AMENDING CHAPTER 2, SPECIFICALLY SECTION 2.2 OF THE LESTER PRAIRIE MUNICIPAL CODE
THE CITY OF LESTER PRAIRIE ORDAINS:
Ordinance No. 281 repeals Section 2.2 of the Lester Prairie Municipal Code and replaces it with a revised Franchise Gas Energy ordinance providing for definitions, granting of franchise, location of facilities, regulations, relocations, indemnification, vacating of public ways or grounds, franchise fees, abandoned facilities, provisions of ordinance and amendment procedures. Said ordinance is divided into eleven (11) main sections, which are summarized herein.
Section 1. This section consists of definitions.
Section 2. This section relates to the adoption of the franchise.
Section 3. This section relates to the location of facilities and other regulations.
Section 4. This section relates to the relocations of gas facilities.
Section 5. This section relates to indemnification and defense of the City.
Section 6. This section relates to the procedure for vacating public ways and public grounds.
Section 7. This section dictates that if there is a change in the form of City government, the successor shall succeed to all of the rights and obligations of the City.
Section 8. This section enable the City to collect franchise fees. It prescribes the form, condition, collection and continuation procedures.
Section 9. This section discusses abandoned facilities.
Section 10. This section describes the provisions of the ordinance.
Section 11. This section describes the amendment procedure.
The foregoing is a summary of Ordinance No. 281, which consists of a nine (9) page document, full text of which is on copy with the City Clerk and is available for review and inspection by the public during normal business hours.
This Ordinance was adopted by the City of Lester Prairie on the 8th day of December, 2008.
