ORDINANCE No. 327
AN ORDINANCE REVISING SECTION 2.8.1, ADDING DEFINITIONS IN 2.8.2 AND ADDING 2.8.7.1 OF THE LESTER PRAIRIE CODE
REGARDING GARBAGE COLLECTION
The City Council for the City of Lester Prairie ordains:
Section 1: Section 2.8.1 currently reads as follows: All garbage and refuse accumulation in the City of Lester Prairie shall be accumulated, conveyed and disposed of by the City of Lester Prairie through its own personnel or its legally authorized agent, the City Collection Contractor. No person shall collect or convey over any of the streets or alleys or the City, or dispose of any garbage accumulated in the City, except the City’s duly authorized personnel or agent.
Section 2.8.1 of the Lester Prairie Municipal Code shall be amended to include the following: All persons residing in the City of Lester Prairie shall have garbage service. All garbage and refuse accumulation in the City of Lester Prairie shall be accumulated, conveyed and disposed of by the City of Lester Prairie through its own personnel or its legally authorized agent, the City Collection Contractor. No person shall collect or convey over any of the streets or alleys or the City, or dispose of any garbage accumulated in the City, except the City’s duly authorized personnel or agent.
Section 2: Section 2.8.2, the following definitions shall be added:
(g) “Snowbirds”. Snowbirds are individuals whose primary residence is in the State of Minnesota and who also reside in another state for a minimum of two (2) months (eight (8) weeks) and a maximum of six (6) months (twenty-six (26) weeks). Prior to being deemed a snowbird, an individual must provide the City Clerk with a forwarding address for billing purposes and submit the “garbage fee waiver” form to the City Clerk on an annual basis for the City Council to approve or deny. For the garbage fee waiver a “year” is defined as June 1st through May 31st.
(h) “Vacant property”. A property is deemed vacant when there is no water usage and no individuals reside at the property due to foreclosure of the property, the owner is residing in a long term care facility, the death of the owner or the property is on the market for sale.
(i) “Extended Vacation”. An individual who resides in Lester Prairie and takes an extended vacation which is defined as a minimum of two (2) months (eight (8) weeks) and a maximum of six (6) months (twenty-six (26) weeks). An individual taking an “extended vacation” may request the garbage fee to be waived by providing the City Clerk with a forwarding address for billing purposes and submitting the “garbage fee waiver” form to the City Clerk on an annual basis for the City Council to approve or deny. For the garbage fee waiver a “year” is defined as June 1st through May 31st.
Section 3: Section 2.8.7.1 shall be added to the Lester Prairie Municipal Code as follows: Suspension of garbage collection and refuse fee. An individual’s garbage collection and refuse fee may be suspended if the City Council determines that the individual is a “snowbird”, the property is “vacant” or the individual is taking an “extended vacation”. If an individual is requesting suspension of the fee, the individual must complete the “garbage fee waiver” form to the City Clerk who will present it to the City Council. The City Council may request additional information from the individual prior to making its determination that the individual qualifies as a “snowbird”, the property is “vacant” or the individual is taking an “extended vacation”. The individual shall provide the requested information to the Council within ten (10) days of the request. The City Council shall make the determination if the individual qualifies as a “snowbird” or the property is “vacant” or the individual is taking an “extended vacation” within ten (10) days of the City Council’s review of the application at its meeting or from ten (10) days from the individual’s submission per the Council’s request.
Section 4: This ordinance shall take effect after its passage and publication.
