CITY OF DELANO
ORDINANCE NO. 0-15-01
An Ordinance adopting the Minnesota State Building Code. This Ordinance: provides for the application, administration, and enforcement of the Minnesota State Building Code by regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in this municipality; provides for the issuance of permits and collections of fees thereof; provides penalties for violation thereof; repeals all ordinance and parts of ordinances that conflict therewith. This ordinance shall perpetually include the most current edition of the Minnesota State Building Code with the exception of the optional appendix chapters. Optional appendix chapters shall not apply unless specifically adopted.
This municipality does ordain as follows:
Section 1. Codes adopted by reference. The Minnesota State Building Code, as adopted by the Commissioner of Labor and Industry pursuant to Minnesota Statutes chapter 326B, including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Labor and Industry, through the Building Codes and Standards Unit, is hereby adopted by reference with the exception of the optional chapters, unless specifically adopted in this ordnance. The Minnesota State Building Code is hereby incorporated in this ordinance as if fully set out herein.
Section 2. Application, Administration and Enforcement. The application, administration, and enforcement of the code shall be in accordance with Minnesota State Building Code. The code shall be enforced within the extraterritorial limits permitted by Minnesota Statutes, 326B.121, Subd. 2(d), when so established by this ordinance.
The code enforcement agency of this municipality is called the City of Delano. This code shall be enforced by the Minnesota Certified Building Official designated by this Municipality to administer the code in accordance with Minnesota Statutes 326B.133, Subdivision 1.
Section 3. Permits and Fees. The issuance of permits and the collection of fees shall be as authorized in Minnesota Rules Chapter 1300. Permit fees shall be assessed for work governed by this code in accordance with the fee schedule adopted by the municipality on July 17, 2007 by Ordinance No. O-07-05.
In addition, a surcharge fee shall be collected on all permits issued for work governed by this code in accordance with Minnesota Statutes 326B.148.
Section 4. Violations and Penalties. A violation of the code is a misdemeanor (Minnesota Statutes 326B.082, Subd. 16).
Section 5. Building Code Optional Chapters. Minnesota State Building Code, Chapter 1300 allows the Municipality to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code.
The following optional provisions identified in the most current edition of the State Building Code are hereby adopted and incorporated as part of the building code for this municipality.
1. 1306: Special Fire Protection Systems:
1306 .0020, Subdivision 3.New Buildings
Section 6. Effective Date of Ordinance. The effective date of this Ordinance is February 17, 2015.
This amendment shall be in full force and effective immediately following its passage and publication. Approved by the Delano City Council on February 17, 2014.

CITY OF INDEPENDENCE
The Planning Commission will hold a public hearing in the Council Chambers at 1920 County Road 90 on Monday, March 9, 2015 at 7:30 p.m. to review the following requests:
1. Elmer Schefers (Applicant/Owner) requests that the City consider the following actions for the property located at 5635 Kochs Crossing, Independence, MN (PID No.s 11-118-24-14-0003):
a. Rezoning from AG – Agriculture to RR - Rural Residential.
b. A Conditional Use Permit to allow a Cluster Development.
c. Preliminary Plat to allow a (14) fourteen lot subdivision.
d. A Comprehensive Plan Amendment to allow a sewer connection for one (1) lot in the proposed development.
2. David and Lise Potter (Applicant/Owner) request that the City consider the following actions for the property legally described as Lot 3, Block 1 Fox Ridge Farms, Independence, MN (PID No. 34-118-24-43-0005):
a. Rezoning from AG-Agriculture to RR- Rural Residential.
b. Preliminary Plat to allow a subdivision of the property into three (3) lots.
3. Tim Druk (Applicant) and Willi Abbott (Owner) request that the City consider the following actions for the property located at 574 Nelson Road, Independence, MN (PID No. 31-118-24-13-0002):
a. A variance to allow a reduced side yard setback for a new home to be constructed on the subject property.
4. Mike Kuka (Applicant/Owner) requests that the City consider the following actions for the properties located at 4405 County Road 92 N, Independence, MN (PID No.s 04-118-24-24-0002 and 04-118-24-31-0001):
a. A conditional use permit to allow a commercial riding stable on the subject property. The stable will host rodeo, horse related and similar events within the existing agriculture accessory structure on the property.
The items highlighted above may have a direct or indirect effect on your property. All persons wishing to be heard with reference to these applications will be given the opportunity at this meeting. Written comments can be directed to City Hall, 1920 County Road 90, Independence, MN 55359. Plans are available for review at the City Office.

Notice of Electronic Voting System
Public Accuracy Test (PAT)
NOTICE IS HEREBY GIVEN, that on Thursday, March 5, 2015 at 4:00 P.M. the Electronic Voting System Public Accuracy Test will be conducted at the Franklin Township Hall located one mile south of the Delano Dairy Queen — 8735 on Wright County Road #16. This test is to insure the integrity of the Annual Township Election that will be held on Tuesday, March 10, 2015. The public is invited to view this test.
