Mayor Graunke called the regular meeting of the Delano City Council/Economic Development Authority of Tuesday, February 3, 2015 to order at 7:00 p.m.
2. Roll Call & Approval of Agenda
Members Present: Mayor Dale Graunke; Council Members Betsy Stolfa, Jack Russek, Jason Franzen, and Holly Schrupp
Members Absent: None

Motion by Jack Russek, seconded by Holly Schrupp to approve the agenda of the Delano City Council/Economic Development Authority of Tuesday, February 3, 2015 with the addition of items 15A, 15B and 15C. Motion carried.

Motion by Betsy Stolfa, seconded by Holly Schrupp to approve the minutes 3A, 3B, 3C, 3D, 3E as submitted and 3E, 3F and 3G as corrected. Motion carried.

Motion by Holly Schrupp, seconded by Jack Russek to approve Consent items 5A1 and 5A2 as submitted. Motion carried.

1. Approve the installation of new flooring in the public works office area.
2. Pay Request No. 11 for the Delano Business Park Development Project.
11. CITY STRATEGY No. 6: Ensure communication and positive relationships between the Council, City Staff, Employees and Commission members.
A. Approve resolution amending Section 212.02, Subd. 3.1 of the City of Delano General Code.
1. Adopt Resolution R-15-03 amending Section 212.02, Subd. 3 of General Code regarding DMU Commissioner payments.
Motion by Holly Schrupp, seconded by Jack Russek to adopt resolution R-15-03 amending Section 212.02, Subd. 3 of General Code regarding DMU Commissioner payments. Motion approved 5-0 by roll call vote.
B. Minutes of the Delano Public Safety Commission meeting of September 22, 2014.
C. Minutes and claims listings of the Delano Water, Light and Power Commission meeting of Monday, December 15, 2014.
15. Other business
A. Discuss Flood Mitigation Progress
B. Discuss Monster Hockey Application
Motion by Betsy Stolfa, seconded by Holly Schrupp to approve the application contingent upon acquiring all necessary insurance and administrative documents. Motion approved with Dale Graunke abstaining.
C. Approve Legacy of Delano Subordination Agreement
Motion by Jack Russek, seconded by Holly Schrupp to approve agreement. Motion approved.

Motion by Holly Schrupp, seconded by Jack Russek to approve the City Claims as submitted. Motion carried.
18. Adjournment

1. Approve pay request to Burschville Construction for Legion Parking Lot pipe improvements for $27,928.
Motion by Betsy Stolfa, seconded by Jason Franzen to approve pay request to Burschville Construction for Legion Parking Lot pipe improvements for $27,928. Motion carried.
2. Consider the lease of the new copier for City Hall.
Motion by Holly Schrupp, seconded by Betsy Stolfa to table this item until the March 3, 2015 meeting. Motion carried.
9. CITY STRATEGY No. 4: Manage the City’s growth so that it is high quality and consistent with the City’s Comprehensive Plan while maintaining the City’s historical culture, characteristics and features.
A. EDA: Conduct Public Hearing and Consider Purchase Agreement for sale of 203 Bridge Avenue East.
1. Conduct Public Hearing.
Motion by Jack Russek, seconded by Jason Franzen to enter into a public hearing to discuss the potential sale of the Rivertown Commercial Building located at 203 Bridge Avenue. Motion carried.
2. Consider purchase agreement.
Motion by Holly Schrupp, seconded by Betsy Stolfa to enter into a purchase agreement for sale of 203 Bridge Avenue East. Motion carried.
13. CITY STRATEGY No. 8: To ensure the public’s safety from crime and manmade or natural disasters.
A. Adopt optional MN Building Code Chapter 1306 – Special Fire Protection Systems subpart 3.
Motion by Jack Russek, seconded by Holly Schrupp to adopt Ordinance O-15-01 adopting the Minnesota State Building Code. This Ordinance: provides for the application, administration, and enforcement of the Minnesota State Building Code by regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in this municipality; provides for the issuance of permits and collections of fees thereof; provides penalties for violation thereof; repeals all ordinance and parts of ordinances that conflict therewith. This ordinance shall perpetually include the most current edition of the Minnesota State Building Code with the exception of the optional appendix chapters. Optional appendix chapters shall not apply unless specifically adopted. Motion carried.
14. CITY STRATEGY No. 9: To ensure the overall aesthetic appeal of the City.
A. Consider approving “Before I Die I Want To…” art application.
Motion by Jason Franzen, seconded by Holly Schrupp to table the application for further information. Motion carried.

Motion by Jack Russek, seconded by Jason Franzen to approve the City Claims as submitted. Motion carried with Holly Schrupp abstaining.
B. EDA Claims
Motion by Holly Schrupp, seconded by Betsy Stolfa to approve the EDA Claims as submitted. Motion carried.

Mayor Graunke called the special workshop of the Delano City Council/Economic Development Authority meeting of Tuesday, February 24, 2015 to order at 6:00 p.m.
2. Roll Call
Members Present: Dale Graunke, Mayor; Councilmembers Betsy Stolfa, Jack Russek, Jason Franzen, and Holly Schrupp
Members Absent: None
Also Present: Phil Kern, City Administrator; Julie Fleming-Wolf, Attorney; Vince Vander Top, City Engineer; Heather Libby, Wenck Associates; Brian Bloch, Finance Director; Scott Dornfeld, Building Official; Paula Bauman, Recorder
3. Special Order of Business
A. Attorney/Client Privilege: Discuss Eden lawsuit.
Motion by Jack Russek, seconded by Betsy Stolfa to enter into executive session to discuss the Eden lawsuit. Motion carried.
Motion by Jack Russek, seconded by Holly Schrupp to exit out of closed session. Motion carried.
B. Discuss downtown floodwall plan.
Vince Vander Top and Heather Libby presented proposed plans of the downtown floodwall along River Street. The proposed plans incorporate more natural landscaping, berms and removable floodwall.
C. Discuss Pavement Management Plan and 2016 Street Reconstruction Plan.
City Engineer Vince Vander Top and Heather Libby reviewed the proposed street projects for 2016 and the cost estimates for the project.
D. Discuss hours of contract with Wright County Sheriff’s Department.
Council discussed the current contract and costs associated with additional hours.
E. Discuss personnel policy draft.
Staff recently updated the current personnel policy per the League of Minnesota Cities recommendations.
F. Discuss expense reimbursement process.
Council discussed how council-related expenses are reimbursed.
G. Discuss Fourth of July taxes.
Mayor Graunke stated he’s been attending the Fourth of July committee meetings stating they’ve recently been made aware they owe the State of MN additional taxes.
H. Discuss the sale of the Rivertown Commercial Building, 203 Bridge Avenue.
With the potential sale of the Rivertown Commercial Building, Brian Bloch recapped the loan repayment schedule.
I. Discuss zoning requirements in Central Business District.
Council briefly discussed the zoning requirements within the Central Business District as it pertains to existing building and the use of decks and porches.
