The Planning Commission will hold a public hearing in the Council Chambers at 1920 County Road 90 on Monday, August 10, 2015 at 7:30 p.m. to review the following requests:

CITY OF DELANOORDINANCE 0-15-03
AN ORDINANCE AMENDING CHAPTER 5, LICENSING AND REGULATION OF ALCOHOLIC BEVERAGES OF THE DELANO CITY CODE
THE CITY COUNCIL OF THE CITY OF DELANO ORDAINS:
Section 1. Chapter 5, Licensing and Regulation of Alcoholic Beverages, Section 503.01, Subd. 10 is hereby amended to read as follows:
Subd. 10. Sunday Sales License Required.
A. A restaurant, club, bowling center, brewpub, taproom, or hotel, as defined herein, with a seating capacity for at least 30 persons and which holds an on-sale intoxicating liquor, 3.2% malt liquor, brewpub, taproom, strong beer or wine license may conduct Sunday sales for consumption on the premises in conjunction with the sale of food between the hours of 10:00 a.m. on Sundays and 1:00 a.m. on Mondays. The licensee must obtain a separate Sunday intoxicating liquor license from the City in order to conduct Sunday sales.
B. A taproom accessory to an approved brewery in the B-4, Central Business Zoning District may obtain a Sunday on-sale license without food sales provided the following conditions:
1. The taproom liquor sales are limited to malt liquor produced on site.
2. The taproom has a seating capacity of at least thirty (30) persons.
3. Sunday sales for on-site consumption shall take place between the hours of 10:00 a.m. on Sundays and 1:00 a.m. on Mondays. The City may impose more restrictive hours if deemed necessary.
C. Brew pubs and small brewers may apply for Sunday off-sale growler licenses subject to Minnesota 2015 Session Laws Chapter 9, Article 2, Sections 2 and 3 to be codified as Minnesota Statutes Sections 340A.24 and 340A.285 for the sale of malt liquor at off-sale between the hours of 8:00 a.m. on Sundays and 1:00 a.m. on Mondays.
Section 2. This ordinance shall be effective immediately upon its passage and publication according to law.
