Notice is hereby given that the Delano City Council will hold a public hearing on Tuesday, September 6th at Delano City Hall at 7:00 PM, or as soon thereafter as the parties may be heard, in the City Council Chambers at Delano City Hall, 234 2nd Street North, Delano, MN 55328, to consider Frontier Communications’ desire to implement a cable franchise in Delano.
All interested parties are hereby notified and invited to submit oral or written comments at said Public Hearing.

The Planning Commission will hold a public hearing in the Council Chambers at 1920 County Road 90 on Tuesday, August 16, 2016 at 6:30 p.m. to review the following requests:
Planning Commission will hold a joint public hearing
1. Jay Fogelson (Applicant/Owner) request that the City consider the following action for the property located at 4618 South Lake Sarah Drive, Independence, MN (PID No. 02-118-24-21-0005):
a. A variance to allow a reduced side yard setback on the east side of the property which would permit a home, deck and garage addition.
2. Windsong Farm Golf Club, LLC (Applicant/Owner) requests that the City consider the following actions for the property located at 18 Golf Walk (PID No. 32-118-24-13-0001) in Independence, MN:
a. A Comprehensive Plan Amendment to allow an expansion of Windsong Golf Club to the property north of CSAH 6.
b. A conditional use permit amendment to allow an expansion of Windsong Golf Club to the property north of CSAH 6 for a new driving range/practice facility (private facility).
3. Hoikka Construction (Applicant) and Beau’Selle Stable (Owner) request that the City consider the following actions for the property located at 1060 Copeland Road (PID No. 29-118-24-31-0001) in Independence, MN:
a. A conditional use permit to allow a Commercial Riding Stable.
b. A conditional use permit to allow an accessory structure that exceeds 5,000 SF.
4. A proposed text amendment to the City of Independence Ordinances as follows:
a. An ordinance opting-out of the requirements of Minnesota Statutes, Section 462.3593

Joy W. Barbre has filed a Petition for Determination of Descent. It is Ordered that on September 2, 2016 at 1:30 p.m., a hearing will be held in this Court at Buffalo, Minnesota, on the petition.
The petition represents that the decedent died more than three (3) years ago leaving property in Minnesota. The petition requests the Court probate and decedent’s Will, determine the descent of such property and assign the property to the persons entitled.
Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the petition will be granted.

The regular meeting of the Board of Education of Independent School District 879, Delano, Minnesota, was held on Monday, July 25, 2016, at Delano City Hall. The meeting was called to order by the chair at 5:47 p.m. with the following members in attendance: Baker, Seguin, Larson, Johnson, Durick.

Board reviewed discussion items: District’s neighboring properties survey, Policy updates, Long-Term Facility Maintenance Plan, POC update, board retreat.
PROGRAM REVIEW

CONSENT AGENDA (approved unanimously)
Board approved the regular meeting minutes of 6-27-16 and the current budget status with year-to-date adjustments, investment transactions, construction bond investment transactions, wire transfers, Minnesota Liquid Assets fund, cash report, revenue and expense fund totals, expense reports and disbursements.
RESOLUTION OF ACCEPTANCE OF GIFTS (approved unanimously)

Board approved retirements/resignations/terminations, recommendations of employment and contract changes which include: Retirements/Resignations/Terminations include: DMS Nurse, District Nurse, TAC Student Monitor, DES 2nd Grade Teacher, TKC Aide, 2nd Shift Lead Custodian. ADMINISTRATIVE AND BOARD REPORTS
Board heard the following administrative reports: Superintendent Schoen reported on building projects. M. Reeder reported on school board member openings and snowplowing bids. D. Johnson reported on Artist in Residency program, Concerts in the Park, early childhood education, preschool, Tiger Kids Club and community education programming. Board heard reports from: MAWSECO.
OLD BUSINESS (approved unanimously)
Approved second read of policies 614 and 614-F due to substantive and/or legal reference changes.
NEW BUSINESS (approved unanimously)
Approved 2016-2018 Community Education Handbook for Non-Certified Employees, first and only read of policies 208, 402, 415, 416, 417, 418, 506, 516, 615, and 905 due to non-substantive and/or legal reference changes, first read of policies 410, 707 and 707.1 due to substantive and/or legal reference changes, Long-Term Facilities Maintenance 10-Year Plan, Resolution Converting Voter Approved Referendum Authority to a Board Approved Referendum Authority.
The meeting adjourned at 7:45 p.m. The preceding is a summary of the unofficial minutes.
