NOTICE TO CONTRACTORS
Electronic Bid Proposals will be received by the City of Delano for the 2020 Infrastructure Improvements project, until 3:00 p.m., Wednesday, April 1st, 2020 at which time such bids will be publicly opened and read aloud.
The work, in accordance with Drawings and Specifications prepared by Wenck Associates, Inc., generally consists of the following major items of work:

Together with selective demolition, traffic control, erosion controls, seeding, and other related appurtenances.
Each bid proposal shall be accompanied by a “Bid Security” in the form of a certified check made payable to the “City of Delano” (OWNER) in the amount not less than five percent (5%) of the total bid, or a surety bond in the same amount, running to the OWNER, with the surety company thereon duly authorized to do business in the State of Minnesota. Such Bid Security to be a guarantee that the bidder will not, without the consent of the OWNER, withdraw his bid for a period of sixty (60) days after the opening of bids, and if awarded a contract, will enter into a contract with the OWNER; and the amount of the certified check will be retained or the bond enforced by the OWNER in case the bidder fails to do so. All bid securities except those of the three lowest bidders will be returned within five days after the opening of bids.
Eligible Bidders for this project must meet the Minimum Criteria as defined in the Responsible Contractor Requirement in accordance with Minnesota Statutes § 16C.285, subdivision 3, and additional criteria required by the OWNER.
A contractor responding to this solicitation document shall submit to the Owner a signed statement under oath by an owner or officer verifying compliance with each of the minimum criteria in Minnesota Statutes, section 16C.285, subdivision 3. The term ‘responsible contractor’ as used in this solicitation document means a contractor as defined in Minnesota Statues, section 16C.285, subdivision 3. Any prime contractor or subcontractor that does not meet the minimum criteria in Minnesota Statutes, section 16C.285, subdivision 3 or fails to verify that it meets those criteria is not a responsible contractor and is not eligible to be awarded the construction contract for the project or to perform work on the project. A false statement under oath verifying compliance with any of the minimum criteria shall render the prime contractor or subcontractor that makes the false statement ineligible to be awarded a construction contract on the project and may result in termination of a contract awarded to a prime contractor or subcontractor that submits a false statement. A prime contractor shall submit to the Owner, upon request, copies of the signed verifications of compliance from all subcontractors of any tier pursuant to Minnesota Statues, section 16C.285, subdivision 3, clause 7. Refer to the contract documents for additional requirements associated with the Responsible Contractor Law.
Bid Proposals shall be submitted on forms furnished for that purpose. Bids shall be submitted electronically through the QuestCDN website. No bidder shall withdraw his bid, without the consent of the OWNER, for a period of sixty (60) days after the date for the opening thereof. The OWNER, however, reserves the right to reject any or all bids and to waive any minor irregularities, informalities or discrepancies. Sealed bids will be accepted until 4:00 p.m. on Wednesday, March 18, 2020 at Independence City Hall located at 1920 County Road 90, Independence, MN 55359 and will be publicly opened at 10:30 a.m. on Thursday, March 19, 2020 at Independence City Hall. They will be considered by the City Council at its meeting on April 7, 2020 at 6:30 p.m.

Bids shall state the price per ton at the quarry, price per ton delivered and placed on City roads, and price per ton delivered to the City and stockpiled. Bids will also be accepted for hauling only.
Bid security in the amount of 5% for 6000 tons of Class 2 Limestone must accompany each bid. Bid security will not be required for all other products.
All bids shall be addressed to the Public Works Supervisor, City of Independence, 1920 County Road 90, Independence, MN 55359, sealed and marked “ROAD MATERIALS.” No faxes will be accepted. A Certificate of Insurance is to be submitted at the time the bid is submitted.

MAGNESIUM AND/OR CALCIUM CHLORIDE APPLICATION ONE YEAR CONTRACT
The City of Independence, MN is accepting sealed bids for the application of approximately 60,000 gallons of 30% magnesium and/or 38% calcium chloride for road stabilization.
Sealed bids will be accepted until 4:00 p.m. on Wednesday, March 18, 2020 at Independence City Hall located at 1920 County Road 90, Independence, MN 55359 and will be publicly opened at 10:30 a.m. on Thursday, March 19, 2020 at Independence City Hall. They will be considered by the City Council at its meeting on April 7 at 6:30 p.m.

City of Independence
Agricultural Preserve New Application
An agricultural preserve application has been received from William McMullen for the property located at 2750 County Line Road. The property contains 69.91 acres. The parcel is eligible under Subdivision 1 of MN Statutes Chapter 473H.03 ‘long-term agricultural land comprising 40 or more acres shall be eligible for designation as an agricultural preserve’.
It is the intent of the City of Independence to bring this before the Independence City Council for approval by Resolution on Tuesday, March 17, 2020 at 6:30 p.m.

NOTICE OF PUBLIC HEARING
REGARDING A FIVE-YEAR CAPITAL
IMPROVEMENT PLAN AND THE
ISSUANCE OF GENERAL OBLIGATION BONDS THEREUNDER
NOTICE IS HEREBY GIVEN that the City Council of the City of Independence, Minnesota (the “City”) will meet on Tuesday, March 17, 2020, at or after 6:30 PM at City Hall, 1920 County Road 90 in the City, to hold a public hearing concerning (1) the adoption of a five year capital improvement plan for the City prepared in compliance with Minnesota Statutes, Section 475.521, as amended (the “Plan”); and (2) the issuance of general obligation bonds (the “Bonds”) to finance certain projects described in the Plan including the renovation, expanding, improvement and equipping of the City’s existing City Hall, public safety and public works facilities. The aggregate principal amount of the Bonds to be issued under the Plan shall not exceed $2,500,000. The City may accept an offer to purchase the Bonds, and the City may sell the Bonds, at a price that results in the receipt of original issue premium in any amount.
If a petition requesting a vote on the issuance of the Bonds, signed by voters equal to five percent (5%) of the votes cast in the City in the last general election, is filed with the City Administrator within thirty (30) days after the public hearing, the City may issue the Bonds only after obtaining approval of a majority of voters voting on the question at an election.
A copy of the Plan is available for inspection in the City Administrator’s office at City Hall. Questions or comments may be directed to the City Administrator at 763-479-0527.
All interested persons may appear and be heard at the public hearing either orally or in writing, or may file written comments with the City Administrator before the hearing.

NOTICE IS HEREBY GIVEN that the City Council of the City of Independence, Minnesota (the “City”) will conduct a public hearing at City Hall, 1920 County Road 90 in the City on Tuesday, March 17, 2020, at or after 6:30 PM, to consider a proposal concerning: (1) the adoption of a five-year street reconstruction plan (the “Plan”); and (2) the issuance of general obligation street reconstruction bonds (the “Bonds”) to finance the reconstruction of certain streets in the City, all pursuant to Minnesota Statutes, Section 475.58, subdivision 3b. The Bonds will be issued in an aggregate principal amount not to exceed $1,400,000. A draft copy of the Plan is on file with the City Administrator and is available for public inspection at City Hall during regular business hours. The City may accept an offer to purchase the Bonds, and the City may sell the Bonds, at a price that results in the receipt of original issue premium in any amount.

LEGAL NOTICE
CITY OF INDEPENDENCE
The City Council will hold a public hearing in the Council Chambers at 1920 County Road 90 on Tuesday, April 07, 2020 at 6:30 p.m. to allow interested citizens an opportunity to comment on the following:
1. A proposed amendment to City Code Section 915 – Regulation of Lake Independence Surface Use. The amendment will consider a revision to the effective elevations for the slow no-wake regulation. The proposed amendment would increase the elevation at which point the slow no-wake regulations would become effective.
Time will be available during the meeting for oral statements from the public. Copies of the proposed ordinance amendment will be available for viewing at City Hall (typically one week prior to the meeting). Written comments can be directed to City Hall, 1920 County Road 90, Independence, MN 55359.
