IN THE MATTER OF THE CONDEMNATION
OF CERTAIN LANDS FOR HIGHWAY PURPOSES
TO THE DISTRICT COURT ABOVE NAMED, the County of Wright brings this Petition and respectfully states and alleges as follows:
I. That this proceeding is commenced pursuant to law in the name of and on behalf of Wright County, State of Minnesota, by Thomas N. Kelly, the duly elected, qualified and acting County Attorney, at the request of the Board of County Commissioners of Wright County.
II. That the County of Wright deems it necessary for highway purposes to obtain the lands herein described, either in fee title, as a permanent easement, as a temporary construction easement, or a combination thereof, together with all structures, trees, shrubs, grass, and herbage on the property herein to be taken, and to keep and have the exclusive control of the same for use of the general public as part of the County State Aid Highway System.
III. That said Board has specifically directed by its Resolution No. 20-01 that said property hereinafter described be acquired through condemnation by eminent domain proceedings for the purpose of highway use.
IV. That said Board is authorized by Minnesota Statutes §162.02, Subd. 5, to acquire rights by eminent domain for this purpose and to proceed pursuant to Minnesota Statutes Chapter 117.
V. That it is the intention of the above-named Petitioner to move the Court for an Order transferring possession of the parcels and the interests herein described prior to the filing of the award by the Court-appointed Commissioners, pursuant to Minnesota Statutes §117.042.
VI. That the following described lands to be taken in these proceedings are situate in Wright County, Minnesota; that the names of all persons appearing of record or known to your Petitioner to be the owners of said lands or interested therein, including all whom your Petitioner has been able by investigation and inquiry to discover, together with the nature of the ownership of each, as nearly as can be ascertained, are as follows:

WHEREFORE, Your Petitioner prays as follows:
1. That it be adjudged that the public use requires the condemnation of the real property herein described.
2. That it be further adjudged that Petitioner is entitled to take and hold such property for the public use herein specified.
3. That the Court appoint Commissioners to appraise the damages which may be occasioned by such taking.
4. That Petitioner have such other and further relief as the Court shall deem just and equitable.

TO THE ABOVE NAMED RESPONDENTS:
YOU ARE HEREBY NOTIFIED, that the County of Wright, the Petitioner in the above-entitled action, intends to take possession of your property, as described in Exhibit A attached hereto, on or after May 1, 2019; and that possession will be taken pursuant to Minnesota Statute § 117.042 for the purposes of construction of highway improvements over the described lands.
YOU ARE FURTHER NOTIFIED, that before taking possession of said property, Petitioner will pay to the owner or deposit with the Court an amount equal to Petitioner’s approved appraisal of value of said property.

1. That your Affiant is a duly appointed Chief Deputy Wright County Attorney and is legal counsel for the Petitioner in the above-entitled eminent domain action.
2. That your Affiant has been directed by resolution of the Wright County Board of Commissioners to acquire highway right-of-way, as a permanent easement, along with a temporary construction easement, over, under, and across the properties as described in the Notice of Motion and Motion filed herewith.
3. That your Affiant commenced this condemnation action more than ninety (90) days prior to the date of requested possession by filing a Petition with the Court and serving on the Respondents a Notice of Intent to Take Possession, and thereby notifying the Respondents of the Petitioner’s intent to acquire the necessary highway easements pursuant to the procedures contained in Minnesota Statutes, Section 117.042.
4. That said highway right-of-way is required for public highway purposes and is needed prior to the filing of an award by the Commissioners eventually appointed by the Court in this matter.
5. That the Petitioner has caused appraisals of value to be completed for the purpose of determining the value of the taking on each parcel. The approved appraisal of value of the taking on the parcels remaining to be acquired in the above entitled matter has been determined to be as follows:

Parcel 14 - $ 7,200.00
TOTAL $23,000.00
6. That prior to the hearing on the attached Motion, the values cited above will be either paid to the landowners or deposited with the Court pursuant to Minnesota Statutes, Section 117.042.

PROCLAMATION NO. 20-01
DECLARING A LOCAL EMERGENCY
WHEREAS, Steve Stotko, the Mayor of the City of Winsted, McLeod County, Minnesota (“Mayor”) finds that under the authority provided by M.S. § Chapter 12 and related laws of the State of Minnesota, the following situation (“Situation”) exists:
Peace Time Emergency Due to COVID 19 Health Pandemic
WHEREAS, on March 11, 2020 the World Health Organization determined that the COVID-19 outbreak constitutes a health pandemic; and
WHEREAS, on March 13, 2020 President Donald J. Trump declared a national state of emergency as a result of the pandemic; and
WHEREAS, on March 13, 2020 Governor Tim Walz issued Executive Order 20-01 declaring a peace time emergency and coordinating Minnesota’s Strategy to Protect Minnesotans from COVID-19; and
WHEREAS, the Mayor finds that the Situation presents a combination of circumstances that are sudden and could not have been anticipated; and
WHEREAS, the Mayor finds that conditions in the City of WINSTED, Minnesota may worsen considerably as a result of the evolving Situation; and
WHEREAS, the Mayor finds that this Situation threatens the health, safety, and welfare of the citizens of the community, and threatens the continuation and efficient delivery of city services; and
WHEREAS, the Mayor finds that the Situation poses a risk or may cause extensive personal injury, damage or disaster to the City if not immediately addressed; and
WHEREAS, the Mayor finds that traditional sources of relief are not able to repair or prevent the injury or loss.
NOW, THEREFORE, the Mayor declares this Situation to be a local emergency effective at 10:00 a.m. on Monday, March 23, 2020.
This declaration of a local emergency will authorize appropriate community containment and mitigation strategies. The portions that are necessary for response to and recovery from the emergency are hereby authorized. To the extent that normal state laws and city policies and procedures impede an efficient response or compliance with federal and state directives or recommendations, the City Administrator, Emergency Manager, and designees are hereby authorized to suspend compliance with those laws, policies and procedures as authorized by the Governor’s Declaration and M.S. § 12.32, and to take those actions deemed necessary to protect the public health and safety.

Important Information Regarding Property Assessments
This may affect your 2020 property Taxes.
The Board of Appeal and Equalization for Winsted Township will meet on April 8, 2020, 6 p.m., at Winsted City Hall, 201 1st St. N., Winsted, MN, lower level Vollmer Room. The purpose of this meeting is to determine whether property in the jurisdiction has been properly valued and classified by the assessor.
If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you disagree with the valuation or classification after discussing it with your assessor, you may appear before the local Board of Appeal and Equalization. The board will review your assessment and may make corrections as needed. Generally, you must appeal to the local board before appealing to the county board of appeal and equalization.

The City of Winsted is requesting funding to assist with the redevelopment of Millerbernd Manufacturing, Incorporated, in the City of Winsted. The funds will be used to assist in the creation of jobs.
