City of Winsted City Council Meeting Council Chambers September 16, 2008 6:00 p.m.
Present: Mayor Steve Stotko Council Member Tom Ollig Council Member Bonnie Quast Council Member Tom Wiemiller Council Member Dave Mochinski
Staff Present: Brent Mareck, City Administrator Deb Boelter, City Clerk-Treasurer
1) Mayor Stotko called the meeting to order at 6:00 p.m.
a) The Pledge of Allegiance was taken.
2) Consent Agenda
Wiemiller motioned to adopt the Consent Agenda as presented. Quast seconded. Motion carried 5-0.
a) Minutes City Council Work Session September 2, 2008
Accepted the minutes of the City Council Work Session of September 2, 2008.
b) Minutes Regular City Council Meeting September 2, 2008
Accepted the minutes of the Regular City Council Meeting of September 2, 2008.
c) Resignation Park Commission JoLynn Cafferty
Accepted the resignation of JoLynn Cafferty from the Park Commission.
d) Appointment Planning Commission JoLynn Cafferty
Appointed JoLynn Cafferty to the Planning Commission e) Parade Permit Holy Trinity * Granted a parade permit to Holy Trinity School for Friday, October 3, 2008 at 10:30 a.m. with the designated route as submitted to the Winsted Police Department. f) Connection Fee Grass Lake Road Utility Project Waived the water and sewer connection fee for the Grass Lake Road utility project.
g) City Hall and Lakefront Promenade Project Pay Request #10
Approved Pay Request #10 in the amount of $326,596.89 to Greystone Construction Company for work completed on the City Hall and Lakefront Promenade project.
h) Sludge Storage Tanks Final Pay Request
Approved the Final Pay Request in the amount of $69,895 to Gridor Construction, Incorporated for work completed on the Sludge Storage Improvements project.
i) Building Permit Report August, 2008
Approved the August, 2008 Building Permit report as presented.
j) Financial Report August, 2008
Approved the August, 2008 Financial report as presented.
k) Claims
Approved the Claims List for September 16, 2008 as presented.
3) No Public Hearings.
4) Old Business
a) Meeting Room Use Policy Vollmer Room
Mareck requested that the Meeting Room Use Policy be tabled and presented at a future meeting. Mareck stated that he would like to conduct more research.
Ollig motioned to table the Meeting Room Use Policy for further research. Mochinski seconded. Motion carried 5-0.
5) New Business a) Papa Tom’s Bar and Grill Sunday Extended Hours of Operation
Boelter presented a request from Tom Sudheimer, owner of Papa Tom’s Bar and Grill, to extend the city’s Sunday On-Sale liquor license hours of operation to begin at 10:00 a.m. Boelter stated that the City of Winsted’s Liquor Ordinance currently allows the liquor establishments in the city to open at 12:00 noon on Sundays.
Boelter stated that the State of Minnesota changed the State Statute a few years ago to allow for liquor establishments to be open and serve alcohol at 10:00 a.m. on Sundays. Each city can establish the time they want to allow liquor establishments to be open on Sundays. When the city’s Liquor Ordinance was amended in 2007, some of the liquor establishments in Winsted attended the public hearing and requested that they be allowed to open on Sundays at 10:00 a.m. The City Council decided to leave the Sunday open time at 12:00 noon.
Tom Sudheimer addressed the City Council regarding his request. Ollig asked Sudheimer if he would approve of a Sunday opening time of 11:00 a.m. Sudheimer stated yes. Wiemiller stated that he is opposed to any liquor establishments opening earlier than 12:00 noon on Sundays.
Ollig motioned to schedule a public hearing for Tuesday, October 7th, 2008 at 6:00 p.m. to amend the Liquor Ordinance to consider extending hours of operation on Sundays. Mochinski seconded. Motion carried 5-0.
6) Department Report
a) Jake Saulsbury, City Engineer, Bolton and Menk, Incorporated reported on the following: Ø Shady Creek Addition improvements. Ø Winsted Municipal Airport improvements. 1. Construction Project for the Beacon and Wind Cone. 2. Airport Master Plan. 3. Capital Improvement Plan (CIP). Ø Water Supply Plan. Ø Grass Lake Road utility service. Ø Miscellaneous drainage issues.
Mayor Stotko asked Saulsbury if Bolton and Menk, Incorporated has obtained additional information on the lake bank large storm water drainage pipes. Saulsbury stated yes and he will present the information at a future City Council meeting.
Mareck stated that staff from Bolton and Menk, Incorporated has been working with the city and contractors on the City Hall and Lakefront Promenade construction project.
Ollig asked Mareck if he has been pleased with the services being provided by Bolton and Menk, Incorporated. Mareck stated yes.
7) Open Forum
a) Community Room Use
Nola Dickhausen, 624 Shady Creek Drive, addressed the City Council. Dickhausen expressed her disappointment with the restrictions placed on the use of the Community Room. Dickhausen stated that the Community Room should be available for the community to use. She asked the City Council to consider allowing the Community Room to be used for family parties; such as, birthdays, anniversaries, etc.
b) Eric Angvall - Minnesota State Representative Candidate
Angvall introduced himself as a candidate for Minnesota State Representative.

City of Winsted City Council Work Session Conference Room September 16, 2008 5:00 p.m.

Staff Present: Brent Mareck, City Administrator Deb Boelter, City Clerk-Treasurer
I. Call To Order
Mayor Stotko called the meeting to order at 5:00 p.m.
II. Updates
Mareck gave updates on the following: A. City Hall and Lakefront Promenade Grand Opening/Open House.
B. Inspection of City Hall and Lakefront Promenade Reviewed punch list items.
C. The city water and sewer connection for the Grass Lake Road project.
D. Entrance sign placement on the Entinger property.
E. Complaint by Frank Bayerl regarding emissions from AAA Galvanizing.
Mareck stated that the city does not have any regulations regarding emissions standards. The Minnesota Pollution Control Agency (MPCA) regulates industrial emissions.
Mareck stated that he was scheduled to meet with representatives from AAA Galvanizing regarding Bayerl’s complaint about the emissions. Mareck will also contact the MPCA.
The City Council discussed and expressed concern about getting involved with an issue that is not under the city’s regulatory authority. The City Council directed Mareck to have the City Attorney, Fran Eggert prepare correspondence to Bayerl regarding the complaint.
F. Liquor license application received.
III. Winsted Municipal Airport
Mareck gave an overview of items discussed at the September 16, 2008 Winsted Municipal Airport Commission meeting.
Ollig recommended that a moratorium be enforced on any additional hangars being built at the airport until the issue of the unsigned leases is resolved.
The City Council directed Mareck to have Bolton and Menk, Incorporated finish preparing their report from the airport surveys and present to the Airport Commission and City Council at their October, 2008 meetings. The City Council will then review the information presented by Bolton & Menk, Incorporated and evaluate the future of the airport.
